Right of Withdrawal

    Withdrawal and cancellation

    INKLY GmbH is based in Switzerland, so Swiss law applies in principle. For consumers resident in the EU/EEA, the mandatory provisions of their country of residence apply in addition. Both are set out separately below.

    1. For customers in Switzerland

    No statutory right of withdrawal for online orders. Swiss law provides no general right of withdrawal or return for contracts concluded via a website. A right of revocation exists under Art. 40a et seq. of the Swiss Code of Obligations only for doorstep sales and contracts resulting from an unsolicited telephone call, where the service exceeds CHF 100. Bookings via INKLY do not fall into that category.

    For appointment bookings, the cancellation terms of the respective studio therefore apply exclusively. They are shown to you during the booking process and form part of the contract between you and the studio.

    2. For consumers in the EU/EEA

    Distance contracts are generally subject to a fourteen-day right of withdrawal (Directive 2011/83/EU).

    Exception for appointment bookings. The right of withdrawal is excluded for services connected with leisure activities where the contract provides for a specific date or period (Art. 16(l) of the Directive; implemented in Germany in § 312g(2) no. 9 BGB). Booking a specific tattoo, piercing, PMU or laser appointment falls under this exception.

    Here too, the studio's cancellation terms apply.

    3. What the right of withdrawal does apply to

    Irrespective of clause 2, consumers in the EU/EEA have a fourteen-day right of withdrawal for contracts not tied to a specific date – in particular:

    • Purchase of platform gift cards (as long as they have not been redeemed)
    • Purchase of AI credits and entering into an AI subscription

    Period. Fourteen days from conclusion of the contract.

    How to exercise it. Inform us by a clear statement – INKLY GmbH, Im Aegler 3i, 8153 Rümlang, Switzerland, legal@inkly.ch. An e-mail is sufficient; no particular form is required.

    Early expiry for digital services. If, at your express request, we begin performance before the period expires, your right of withdrawal ends once the service has been fully performed. For AI credits this is the case as soon as you have triggered a generation paid for with them.

    Consequences. We will reimburse all payments received from you without undue delay and at the latest within fourteen days of receiving your statement, using the same means of payment you used.

    4. Deposits paid to studios

    A deposit is part of the contract between you and the studio, even though we process it technically. Whether it is refunded on cancellation is governed by the studio's cancellation terms. If the studio cancels the appointment, it is refunded in every case.
